At about 1 a.m. on Tuesday, August 20th, the Marshall County Central Dispatch Center received a call from another driver about the poor driving behavior of a young man.

Deputy Geiger with the sheriff’s department stopped the suspect vehicle, a yellow 2019 Jeep at King Road and U.S. 30 for traffic violations.

The driver, 26-year-old Victorino Ariza Castillo of South Bend, appeared intoxicated. He was given field sobriety tests and submitted to a certified breath test.  Castillo’s breath sample showed him at .156%.

Castillo was charged and booked into the Marshall County Jail for operating a vehicle while intoxicated.  The cash bond was set at $1,500 and his vehicle was impounded by Lyon Towing.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
