A settlement agreement with E & B Paving for the Union Road project was approved by the County Commissioners on Monday.
County Attorney Jim Clevenger read the settlement agreement which states on July 25th that Jason Peters, the County Highway Superintendent accepted a proposal from E&B to grade and pave a portion of Union Road for $394,680. Peters authorized the paving of Union Road, which was contrary to state law and violated county policies.
The agreement stated that E&B learned afterward that the state Public Works Project Laws had not been followed and a contract was not let following Indiana Code.
The agreement has Marshall County paying E & B Paving $344,680 as the full and final payment within 60 days of approval of the agreement.
The agreement is not to be construed as an admission of any wrongdoing by E&B Paving.
Clevenger said the agreement is the result of negotiations between the parties. He said the parties involved agreed that a portion of the discussions, negotiations, calculations, and information supportive of the agreement contained proprietary information of E&B and confidential personnel information of Marshall County. Both parties agree the information will remain confidential.
