County Police arrest Ft. Wayne man for OWI

An officer with the Marshall County Sheriff’s Department arrested a Fort Wayne man for operating while intoxicated on March 23rd.

Around 9:30 Sunday night, deputies with the Marshall County Sheriff’s Department were notified of a possible intoxicated driver in the northeast portion of the county.

Deputy Geiger located the vehicle and conducted a traffic stop on Fir Road south of 7th Road for traffic infractions.

Sixty-year-old Timothy Byers of Ft. Wayne had been drinking and submitted to field sobriety tests. He was offered a certified breath test and agreed. Byers tested at .14% and was taken into custody.  He was arrested for operating a vehicle while intoxicated, transported to the Marshall County Jail, and held on a $1,500 cash bond.  

Bremen Police also assisted with the traffic stop, and Lyons Wrecker Service towed the vehicle.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings, entitled to be represented by counsel, and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
