Pena-Cardenas arrested for OWI

A vehicle that failed to stop at the stop sign on West Harrison Street near North Plum Street was pulled over Thursday night, October 17th just before 11 and the driver was arrested. 

Officer Lovely with the Plymouth Police Department was patrolling the area and observed a white Chevrolet Suburban fail to stop at the stop sign.  The vehicle also crossed the center line and the officer initiated a traffic stop.

During his investigation, he believed the driver, Vidal Pena-Cardenas,42, had been drinking alcohol.  Pena-Cardenas was given standardized field sobriety testing and then a certified chemical test.  He had a breath alcohol level of .136 g/210L. 

Pena-Cardenas was taken to the Marshall County Jail and booked in for operating a vehicle while under the influence of alcohol as a Class C Misdemeanor.

 

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
