Last Thursday, August 29th, at approximately 8:15 in the evening, Officer Wozniak with the Marshall County Sheriff’s Department initiated a traffic stop on a tan 2000 Pontiac Bonneville on U.S. 31 near 12th Road. During the investigation, it was found that the driver and sole occupant, 48-year-old Toisan D. Fox of Wakarusa, was operating the vehicle with a driving status of suspended prior.

One of the Marshall canine officers was requested to the scene to utilize his canine partner, "Diesel". Diesel alerted to narcotics and a probable cause search of the vehicle resulted in officers locating a large amount of suspected cocaine packaged for distribution.

Fox was booked and processed for a level 2 felony dealing cocaine or narcotic drug, a level 4 felony possession of cocaine or narcotic drug, and driving while suspended prior.

Readers are reminded that charging information supported by an affidavit of probable cause is merely an allegation that a crime has been committed and that there is only probable cause to believe a crime has been committed. They are presumed innocent throughout the proceedings and are entitled to be represented by counsel and entitled to a trial by jury at which the State is obligated to provide proof beyond a reasonable doubt before a judgment of guilt may be made.
